Products are sold and licensed for use by end-users only for research or laboratory use and are not to be used on humans or for clinical diagnostic or drug purposes. Any use of Products for diagnostic or therapeutic purposes, or any purchase of Products for resale or distribution (alone or as a component), requires a separate license from Alphazyme. The purchase of Product does not grant any right or license to use such Product in the practice of any methods covered by Alphazyme patents or applications.
Alphazyme recommends that the end-user of purchased Product follow Good Laboratory Practice (GLP) guidelines. Alphazyme disclaims any and all responsibility and liability for any injury or damage which may be caused by the failure of purchaser or end-user to follow said guidelines and specific product literature. It is the user’s responsibility to determine for himself or herself the suitability of any material and/or procedure for a specific purpose and to adopt such safety precautions as may be necessary.
Alphazyme warrants that the Product will meet the specifications stated on the technical data sheet for that product, and agrees to replace the product free of charge if the product does not conform to the specifications. Notice for non-conformity and request for replacement must be given within 30 days of receipt of Products. In consideration of the above warranty by Alphazyme, the buyer agrees to and accepts the following conditions:
That this warranty is in lieu of all other warranties, expressed or implied;
That ALL WARRANTIES OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY EXCLUDED OR WAIVED;
That the buyer’s sole remedy shall be to obtain replacement of the product from Alphazyme; and
That this remedy is in lieu of all other remedies or claims for damages, consequential or otherwise, which the buyer may have against Alphazyme. Alphazyme shall not be responsible for replacing Product that has been improperly stored, handled, or used by buyer or End-User.
Trademarks referenced herein are either registered trademarks or trademarks of Alphazyme in the U.S. and/or other countries. The names of actual companies and products mentioned herein and/or third party trademarks, trade names and logos contained herein may be the trademarks of their respective owners. Any rights not expressly granted herein are reserved.
